Terms of Service

PixelCork is a trading name used by Jason Clark, based in Cork, Ireland. Contact details are hello@pixelcork.eu and +353 89 477 5081. These terms provide the general basis on which PixelCork supplies website design, development, SEO, hosting and maintenance services. A written quote or project agreement may add project specific terms. If there is a conflict, the signed project agreement takes priority.
Quotes and scope
Website prices shown online are starting package prices. A quote describes the included pages, features, content, timetable, revisions and fees. Work outside that scope requires written agreement and may cost extra. A quote is normally valid for 30 days.
Payment
Unless a quote says otherwise, 50 percent is due before work begins and the remaining balance is due before launch or final file transfer. Hosting and maintenance are billed in advance. Late payment may pause work or service after reasonable notice. VAT is charged only where legally applicable and will be stated on the quote or invoice.
Client responsibilities
The client must provide accurate instructions, lawful content, timely feedback and any access reasonably needed for the project. The client confirms that it owns or has permission to use all supplied text, images, logos, fonts and other materials. Delays in content, feedback, payment or access may change the delivery date.
Revisions and approval
The number of revision rounds is stated in the quote. Additional changes may be charged separately. Approval by email or through the agreed project process allows work to move to the next stage. Minor faults reported within the stated launch support period will be corrected where they relate to the agreed work.
Cancellation and consumer rights
Consumers entering a distance or off premises service contract may have a statutory 14 day cancellation right. If a consumer asks PixelCork to begin during that period, they may have to pay a proportionate amount for work completed before cancellation. The cancellation right may end after the service is fully performed where the consumer expressly requested early performance and acknowledged that consequence. Nothing in these terms removes mandatory consumer rights.
Business cancellations
For business clients, the initial payment reserves project time and covers discovery and early work. If the client cancels, fees remain payable for work completed and committed third party costs. Any unused balance will be returned after those amounts are deducted. The project agreement may set a different cancellation schedule.
Intellectual property
After all invoices are paid, the client receives ownership of the final custom website files created specifically for the project, unless the quote states otherwise. PixelCork retains ownership of reusable methods, tools, libraries, know how and pre existing materials. Third party assets remain subject to their own licences.
Portfolio use
PixelCork may identify the client and display completed public work in its portfolio and marketing unless confidentiality has been agreed in writing. Confidential information will not be published.
Third party services
Domains, hosting, analytics, payment systems, plugins and other external services are governed by their providers. PixelCork is not responsible for a third party outage, policy change or account suspension outside its reasonable control, but will provide reasonable assistance where covered by the agreed service.
SEO and business results
PixelCork applies good practice but does not guarantee search rankings, traffic, enquiries, revenue or any particular business result. Search engines and customer behaviour are outside PixelCork's control.
Liability
Nothing limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights. Subject to that, PixelCork's total liability arising from a project will not exceed the fees paid for that project. For business clients, PixelCork is not liable for indirect loss, lost profit, lost opportunity or loss of data where reasonable backups were the client's responsibility.
Suspension and termination
Either party may end an ongoing service by giving the notice stated in the quote. PixelCork may suspend or terminate service for material non payment, unlawful use, abuse, security risk or serious breach after reasonable notice where circumstances allow.
Governing law and complaints
These terms are governed by Irish law and disputes are subject to the Irish courts, without removing any consumer right to use another forum required by law. Complaints should be sent to hello@pixelcork.eu so a practical resolution can be attempted first.
